By downloading, installing, or using the My Avocado mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

My Avocado is a premium mobile application that provides comprehensive features including:

• Unlimited baby development tracking (feeding, sleep, diapers, milestones)
• AI-powered midwife chat support for pregnancy and baby care guidance
• AI Report generation for tracking summaries and insights
• Community features to connect with other mothers worldwide
• Advanced health and milestone tracking tools
• Growth charts, analytics, and detailed reports
• Vaccination guidelines and reminders
• Data export functionality
• Multiple baby profile support with nicknames
• Dark mode and language customization

3. Purchase and Payment

My Avocado requires a one-time purchase through the App Store or Google Play Store. This purchase includes:

• Lifetime access to all app features
• Unlimited usage with no monthly limits (subject to fair use policy)
• All future updates and new features at no additional cost
• No recurring subscriptions or hidden fees

Payment processing is handled by Apple App Store or Google Play Store according to their respective terms and refund policies. Pricing may vary by region and is displayed in your local currency at the time of purchase.

4. Eligibility

You must be at least 13 years old to purchase and use the App. Users under 18 must have parental consent. The App is intended for personal, non-commercial use only by individuals who have made the required purchase.

5. User Accounts

After purchasing the app, you need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and current information

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any unlawful or prohibited purpose
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Upload or share harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use the App to spam or harass other users
• Reverse engineer, decompile, or attempt to extract the source code

7. AI Features - Fair Use Policy

7.1 Acceptable AI Usage

The AI Midwife and AI Report features are intended for:

• Asking questions about pregnancy, childbirth, and baby care
• Seeking guidance on feeding, sleep, and development
• Generating reports based on your baby's tracking data
• Obtaining general health and wellness information
• Learning about milestones and developmental stages

7.2 Prohibited AI Usage (Abuse)

The following constitute abuse of the AI features and are strictly prohibited:

• Excessive or automated queries (e.g., sending hundreds of messages in a short time)
• Using the AI for purposes unrelated to pregnancy, babies, or childcare
• Attempting to circumvent usage limits or exploit the system
• Sharing or reselling AI responses for commercial purposes
• Using offensive, abusive, or inappropriate language
• Testing or probing the AI system to find vulnerabilities
• Generating content that violates our community guidelines

7.3 Consequences of AI Abuse

If we detect abuse of the AI Midwife or AI Report features, we reserve the right to:

• Issue a warning to your account
• Temporarily restrict access to AI features (e.g., for 24-48 hours)
• Permanently disable AI features for your account while maintaining access to other app features
• In severe cases, terminate your account entirely without refund

We monitor AI usage patterns to ensure fair access for all users. Our automated systems and manual reviews help identify abuse. Decisions regarding AI abuse are at our sole discretion.

8. Health Disclaimer

IMPORTANT MEDICAL DISCLAIMER:

• The App is for informational and tracking purposes only
• Content provided, including AI responses, is not a substitute for professional medical advice, diagnosis, or treatment
• Always consult with qualified healthcare professionals for medical decisions
• In case of emergency, contact emergency services immediately (call 911 or your local emergency number)
• We do not provide medical diagnoses or treatment recommendations
• The AI Midwife is an educational tool powered by artificial intelligence, not a licensed medical professional
• Never disregard professional medical advice or delay seeking it because of information from the App

9. Content and Intellectual Property

9.1 Our Content

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, software, and AI models, are owned by My Avocado and are protected by intellectual property laws.

9.2 Your Content

You retain ownership of content you create or upload to the App (baby profiles, tracking data, photos, journal entries, etc.). By using the App, you grant us a license to use, store, and process your content to provide the App's services.

9.3 Data Deletion

You can delete your data at any time:

• In-App Deletion: Go to Settings > Delete my Data to remove all your information
• Complete Account Deletion: Email us at support@myavocadoapp.com to permanently delete your account
• Data Transfer: Email us at support@myavocadoapp.com to request a copy of your data

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App. Key points include:

• We use Supabase for secure cloud storage and authentication
• We support Sign in with Apple and Google Sign-In
• We do NOT sell your personal information to third parties
• AI conversations are stored securely and used to improve the service
• You can export or delete your data at any time

11. Third-Party Services

The App integrates with third-party services including:

• Supabase: For secure data storage, authentication, and real-time synchronization
• Sign in with Apple: For secure authentication
• Google Sign-In: For secure authentication
• RevenueCat: For subscription management (if applicable)
• AI Service Providers: For AI Midwife and AI Report functionality

Use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. App Updates and Changes

We may update the App from time to time to:

• Improve functionality and user experience
• Add new features and capabilities
• Fix bugs and security issues
• Enhance AI responses and accuracy

We reserve the right to modify or discontinue any feature of the App at any time with reasonable notice. However, we strive to maintain and improve all core features that users have purchased.

13. Community Guidelines

When using community features (chat, forums), you must:

• Be respectful and supportive of other mothers
• Not share personal identifying information publicly
• Not post offensive, harmful, or inappropriate content
• Not spam or advertise products/services
• Respect others' privacy and experiences
• Report any abusive behavior to our support team

14. Disclaimers and Limitations of Liability

14.1 Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of data or information
• Service interruptions or AI feature unavailability
• Decisions made based on AI responses or app information
• Any health-related issues or medical outcomes

15. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Your content or data uploaded to the App

16. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms, including but not limited to:

• Abuse of AI features (AI Midwife or AI Reports)
• Violation of community guidelines
• Fraudulent or illegal activity
• Repeated violations after warnings

You may stop using the App at any time. Upon termination, your right to use the App ceases immediately. However, provisions related to intellectual property, disclaimers, and limitations of liability survive termination.

17. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes will be resolved in the appropriate courts. For users in the European Union, you have the right to bring claims in your local courts.

18. Changes to Terms

We may modify these Terms from time to time to reflect:

• Changes in app features or functionality
• Legal or regulatory requirements
• User feedback and improvements

We will notify users of material changes through the App or email. Continued use of the App after changes constitutes acceptance of the new Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Avocado regarding your use of the App and supersede any prior agreements.
